what is a Will?

Quite simply, a valid Will makes sure that the correct money and items you leave behind when you die, goes to the correct people at the correct time.

 

In other words, by making a Will you are remaining in control of how, where and when your estate is divided up.

. . . and why do I need one?

Having a valid Will is the only way to be absolutely sure that your estate and all your belongings are dealt with just as you wish when you die. Many people assume everything passes on automatically to your spouse - it is not this simple.

 

If you die without a valid Will in place, the law of the country that you live in will decide what happens to your estate. The outcome of what happens can also be influenced by laws of other countries where you may have assets, for example a holiday home in a different country. This can take a very long time to sort out and resolve.

 

By making a Will you are remaining in control of how, where and when your estate is divided up. If you have children, your Will also makes sure that they are looked after according to your wishes and more importantly that they are looked after by the people you’ve chosen to do this important role. If you die without leaving a valid Will specifying this, your children will come under the care of your Local Authority.

 

Although most people know they should have a Will, 60% of the UK adult population do not have one. Of the 40% that do have a Will, one in four do not reflect their wishes or are simply not valid. Often that is due to change of circumstance or not signing the Will properly.
